Criteria 2 has been superseded in March 2015 and it appears to relate to the old CSH level 4. The Deregulation Act 2015 amended the Planning and Energy Act 2008 and removed clause 1(c) which allowed LPAS to have a requirement in a Development Plan that development should comply with energy requirements that exceed the energy requirements of the building regulations.
