Question 1 - Legally Compliant

We consider that the Southbourne Allocation DPD, as published for Regulation 19, is capable of meeting the tests of compliance under the legacy plan making system, subject to the Examiner's review of the detailed evidence.

We note that the Council's Regulation 19 report refers to updated viability evidence and a "Viability Appraisal" alongside a "report on potential vehicular bridge construction costs" which form part of the evidence base for the submission DPD. The report also confirms that an initial viability report was undertaken at Regulation 18 stage and that this has been updated for Regulation 19.

On this basis, and subject to the examiners assessment we consider that the DPD is supported by an appropriate and proportionate evidence base for compliance purposes.

Question 2 - Soundness

We consider that the Southbourne Allocation DPD, currently framed with the East Option and with access via South Lane in the north and Inlands Road in the south with through traffic restricted to a bus/emergency "gate" is capable of being found sound against the four tests in the September 2023 NPPF being:

Positively prepared: The DPD sets out a clear strategy for around 800 new homes in Southbourne with associated infrastructure, community facilities and open space, responding to the Chichester Local Plan.

Justified: the East Option with access via South Lane in the north and Inlands Road in the south [with through traffic restricted to a bus/emergency "gate"] is supported by the Council's assessment framework, which has weighed transport, environmental, landscape and deliverability considerations. The DPD documents describe how the settlement spreads out to the east with Inlands Road and north with South Lane.

Effective: The Council's Regulation 19 report confirms that viability work undertaken at Regulation 18 has been updated and factored into the evidence base for the submission DPD.

Consistent with national policy: The DPD's strategy is consistent with the September 2023 NPPF's emphasis on delivering homes, well designed places, coordinated infrastructure and up to date evidence.

This consultation response represents our views as engaged; committed and supportive landowners of the 7.1 acres known as 'Land South of Inlands Barn and East of Inlands Road' HELAA reference: HSB0034.
