Response to 5.2: The Council are not the statutory provider therefore have no legal authority over the SRN. Only National Highways can provide the relevant required improvements to the network. Without a s278 agreement in place then the landowner/developer has no protection or redress if the highway improvements are not provided as per the s278 agreement. The Council have stated that this long-established practice has changed but failed to state the reasons why it needs to do so. The Council have entered into an agreement with National Highways which would allow them to collect and hold funds on behalf of that body for a period of up to 20 years. However, it has failed to publicly publish this very important legal agreement/document. Without the ability to review this legal agreement/document it is impossible to reach a fully informed opinion on this matter. Thereby this consultation process in this instant must be found wanting.
